A 9-year-old girl accidentally shot and killed by her older brother Saturday could have survived had she received prompt medical care, a criminal complaint filed Tuesday said.

Instead, the girl and her five siblings, who range in age from 10 to 1, were home alone with no way to reach their parents, who were out shopping, the charging document said.

Marcel Jelks and Talisha Lee now face multiple charges, including child neglect and possession of a firearm by a felon.

According to the criminal complaint, Miyanna Jelks' older brother found the girl playing with the 9 mm Smith & Wesson in their parents' bedroom, took the weapon from her and accidentally shot her in the lower portion of her neck.

The girl immediately fell to the ground, crawled around and fell down a flight of stairs, leaving a trail of blood. Marcel Jelks found her on the living room floor when he returned home and immediately took her to a hospital. Doctors tried to save her, but she was pronounced dead within 45 minutes of arriving, the complaint said.

Investigating officers found drug paraphernalia and marijuana inside the home that appeared to be packaged for street sales, prosecutors said.

If convicted, Marcel Jelks and Talisha Lee each face up to 35 years in prison for the neglect and weapons charges. Jelks also faces an additional five years in prison on the drug charge.
